Privacy policy.

Who this policy is for

This policy describes how Maxwell Delali Midodzi, a REALTOR® licensed in Newfoundland & Labrador and operating under eXp Realty, collects, uses, and protects your personal information when you contact me through this website or one of my intake forms.

This is my personal practice policy. eXp Realty has its own brokerage-level privacy practices that also apply once you become a client; ask me or your broker for that document.

What information I collect

I only collect information you choose to share with me. That usually means:

• Contact details, name, email address, phone number, submitted via the buyer or seller intake form, or sent directly by email.
• Property & preferences, your budget, areas of interest, must-haves, current living situation, timing, submitted via the intake form.
• Transaction information, once you become a client, details about properties we view, offers we discuss, and the eventual transaction (purchase agreement, conditions, closing dates).
• Identification & financial information, only when legally required at the offer stage (e.g. proof of funds, FINTRAC identification per Canadian anti-money-laundering rules). Held only as long as required.

I don't use analytics, ads, or tracking pixels, and I don't build a profile of you. Two honest technical notes: this site saves one small setting in your browser (local storage) to remember you dismissed the cookie notice, which is not a tracking cookie; and the homepage plays background video hosted by Pexels, so your browser connects to their servers to load it, as with any embedded video. My web host (Vercel) also keeps standard server logs, as all websites do. If I ever add analytics, I'll update this page.

How I use your information

I use the information you share with me only for the purposes you'd reasonably expect:

• To respond to your inquiry and arrange a follow-up conversation.
• To find, evaluate, and recommend properties that match what you've told me you're looking for.
• To prepare and submit offers, manage transactions, and coordinate with your lender, lawyer, inspector, and the other side's REALTOR®.
• To send you transaction-related updates by email, text, or phone.
• To send you occasional listing alerts, market updates, or follow-up check-ins, only if you've indicated you want them.

I do not sell or rent your information to anyone. Ever.

Who has access to your information

The default answer is: only me.

The narrow exceptions are people I work with on your behalf during an active transaction:

• The other party's REALTOR® and brokerage (the bare minimum needed to negotiate and complete the deal).
• Your lender, lawyer, and home inspector (the ones you choose to engage).
• Provincial regulators and the Multiple Listing Service (MLS) where required by law or REALTOR® rules.
• My brokerage (eXp Realty) for compliance and record-keeping required by Newfoundland & Labrador real-estate law.

How your information is stored

Your information is stored in my Customer Relationship Management (CRM) system, which is hosted on infrastructure provided by Supabase (database) and Vercel (web hosting). Both providers offer industry-standard security (HTTPS, encryption at rest, restricted access).

Emails I send and receive about your transaction are also retained in my Gmail account, which is covered by Google's privacy and security practices.

How long I keep your information

If you're a client, I'm required to keep transaction and identification records for at least five years under Canada's anti-money-laundering law (the PCMLTFA, administered by FINTRAC). In practice I keep complete transaction files for seven years after closing, to line up with Canada Revenue Agency guidance and eXp Realty brokerage policy. Some records may be kept longer if there's an active dispute or audit.

If you contacted me but never became a client, I'll keep your inquiry on file for up to 2 years so I can follow up if your situation changes, unless you ask me to delete it sooner.

Your rights

Under Canadian privacy law (PIPEDA), you have the right to:

• See what information I hold about you.
• Correct anything that's inaccurate.
• Withdraw consent for me to keep contacting you (subject to ongoing legal record-keeping obligations).
• Complain to the Office of the Privacy Commissioner of Canada if you believe I've mishandled your information.

Children's information

This site is not directed at children under 16. I don't knowingly collect information from minors. If you believe a child has submitted information through one of my forms, contact me and I'll delete it.

Changes to this policy

If I update this policy, I'll change the "last updated" date at the top and post the new version here. Material changes (e.g. if I ever add analytics tracking) will be highlighted in plain language.
